Introduction

These Terms of Service (“Terms”) govern your access to and use of the Home Harvest website, services, content, communications, downloadable materials, and any related offerings provided by Home Harvest (“Home Harvest,” “we,” “our,” or “us”). These Terms are intended to explain the rules, conditions, and limitations that apply when you visit our website, request information, submit a form, download a resource, subscribe to our newsletter, request a quote, book a service, purchase a service package, enroll in a maintenance plan, or otherwise interact with our business.

By accessing our website, requesting a quote, submitting your information, booking a service, or otherwise engaging with Home Harvest, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our website or services.

Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others, restrict or inhibit anyone else’s use of the website, or interfere with the security or operation of the website. You must not use this website to transmit harmful code, attempt unauthorized access to any part of the site, submit false or misleading information, or engage in conduct that could damage Home Harvest or its users.

We reserve the right to suspend, restrict, or terminate access to the website or any portion of it at any time, without notice, where we believe it is necessary to protect our business, our users, or the integrity of the website.

Overview of Our Services

Home Harvest provides home food garden services and related support. Our services may include, without limitation, the installation of wooden planter boxes, the creation of raised soil gardens, layout planning, planting strategy, seasonal garden services, maintenance plans, cleanup, and related garden add-ons. We may also provide educational content, planting guides, newsletters, recommendations, blog content, and other informational resources through our website and communications.

Our services may be offered as fixed packages, package ranges, custom projects, recurring maintenance plans, one-time seasonal services, or optional upgrades and add-ons. All services are subject to availability, seasonal conditions, service area limitations, operational capacity, and our acceptance of the project.

Service Packages and Offerings

Home Harvest may offer wooden planter box packages and raised soil garden packages in various sizes and service levels, including starter, home garden, and premium options. Package features may vary depending on the selected offering and may include planter size or garden size, soil type, plant variety, layout planning, planting strategy, installation, and cleanup.

We may also offer optional add-ons and upgrades, including but not limited to extra soil depth, trellis systems, pest netting, drip irrigation, seasonal replanting, cedar upgrades, and other related materials or features. In addition, Home Harvest may offer maintenance services and garden care plans, including monthly check-ins, inspections, pruning, weeding, replanting, fertilizing, pest-related support, advice, and other forms of seasonal or ongoing care.

Package descriptions, feature lists, and examples of services shown on our website are intended for general informational purposes. The exact scope of a project may vary depending on the selected package, site conditions, seasonal availability, and any customizations agreed upon in writing.

Quotes, Pricing, and Price Ranges

Any quote, estimate, package price, price range, promotional offer, or pricing information provided by Home Harvest is subject to change unless expressly confirmed in writing. Prices shown on the website, in promotional materials, or in other communications may be starting prices, estimated ranges, or general package prices and may not reflect the final project cost in every case.

Final pricing may vary based on a number of factors, including site conditions, accessibility, travel distance, material costs, customization requests, labour requirements, add-ons, soil volume, upgrades, site preparation needs, property conditions, service frequency, and other project-specific considerations. If site conditions differ from what was reasonably expected, or if the scope of work changes before or during the project, Home Harvest reserves the right to revise the quoted price accordingly.

A quote does not create a binding agreement until it has been accepted and confirmed by Home Harvest.

Deposits

Home Harvest requires a 35% deposit to confirm bookings for installation services, including wooden planter box installations, raised soil garden installations, and certain custom, upgraded, or higher-value projects. The deposit secures your place in our schedule and helps cover the time, planning, coordination, and preliminary costs associated with preparing for your project.

A booking is not considered confirmed until the required deposit has been received. Until that time, Home Harvest reserves the right to keep the requested date available to other customers and is under no obligation to begin planning, scheduling, purchasing, or reserving labour or materials for the project.

Deposits may be applied toward the total project price. By paying the deposit, you acknowledge and agree that Home Harvest may begin administrative preparation, scheduling, project coordination, and, where applicable, material planning or purchasing in reliance on your booking.

For certain larger, more customized, or more complex projects, Home Harvest reserves the right to require a different deposit amount, which will be communicated in writing before the booking is finalized.

Payment Terms

Unless otherwise agreed in writing, the remaining balance for installation services is due on the day of installation or immediately upon completion of the work. For maintenance plans, recurring care services, add-ons, upgrades, seasonal replanting, or other ongoing services, payment terms may be set out separately in a quote, invoice, care plan, service agreement, or booking confirmation.

All prices, package ranges, and quoted amounts are in Canadian dollars unless otherwise stated. Home Harvest reserves the right to revise final pricing where project scope changes, additional services are requested, site conditions differ from what was originally disclosed, or unexpected issues arise that affect materials, labour, timing, or delivery of the service.

If payment is not made when due, Home Harvest reserves the right to delay services, withhold future bookings, suspend ongoing work where lawful and practical, cancel future scheduled services, or take other reasonable steps to recover the outstanding balance.

Cancellations, Rescheduling, and Refunds

Because our services require scheduling, planning, and, in many cases, the allocation of labour and materials, cancellation and rescheduling requests may affect our operations and availability. Customers are encouraged to provide as much notice as possible if they need to cancel or reschedule a service.

Deposits are generally non-refundable once the project has been scheduled, planning has begun, or materials have been purchased or allocated for the booking. This is because Home Harvest may incur real costs and lose other booking opportunities in reliance on the confirmed service date.

If a customer cancels with sufficient notice and before substantial preparation has occurred, Home Harvest may, in its sole discretion, offer a partial refund, service credit, or rescheduling option. Any such accommodation is not guaranteed and will depend on the timing of the cancellation, the nature of the project, and the costs already incurred.

Home Harvest reserves the right to reschedule services where necessary due to weather, unsafe site conditions, material shortages, illness, supply issues, scheduling conflicts, or other events beyond our reasonable control. In such cases, we will make reasonable efforts to provide notice and arrange a new service date within a reasonable timeframe.

If a customer repeatedly reschedules, fails to provide reasonable site access, or is unavailable at the scheduled service time, Home Harvest reserves the right to treat the booking as cancelled and retain all or part of the deposit to cover lost time, planning, and scheduling impacts.

Maintenance Plans and Ongoing Services

Home Harvest may offer garden care plans or maintenance services, including but not limited to monthly check-ins, light pruning, weeding, inspections, advice, replanting, fertilizing, pest-related support, and general seasonal care. Maintenance plans are offered subject to availability, seasonal suitability, scheduling, and service area limitations.

Maintenance plans do not guarantee plant survival, harvest success, pest elimination, disease prevention, or uninterrupted garden performance. Garden outcomes remain dependent on factors such as weather, soil health, watering practices, sunlight, wildlife, pests, disease, and the general condition of the site.

If maintenance services are offered on a recurring basis, additional terms relating to schedule, billing, frequency, cancellation notice, and service scope may be set out in a separate maintenance agreement, care plan description, invoice, or booking confirmation.

Customer Responsibilities

Customers are responsible for ensuring that all information provided to Home Harvest is accurate, complete, and current. Customers are also responsible for ensuring that the work site is reasonably safe and accessible for installation, maintenance, delivery, or inspection. This includes providing accurate property details, clear access to the work area, and disclosure of any known issues that may affect the work.

Customers are responsible for obtaining any permissions, approvals, consents, or authorizations required for work to be performed on the property. This may include landlord approval, condominium approval, homeowner association approval, municipal compliance, or any other required permission. Home Harvest is not responsible for delays, added costs, or project issues arising from a customer’s failure to obtain proper authorization.

Site Conditions and Project Limitations

Home Harvest provides recommendations and services based on visible site conditions, customer-provided information, and ordinary assumptions. We are not responsible for hidden conditions, inaccurate measurements, undisclosed drainage issues, underground obstacles, buried utilities, soil contamination, pest infestations, structural problems, boundary disputes, by-law restrictions, or legal or physical site issues that are unknown to us at the time of quoting or service.

If unexpected site conditions are discovered before or during the project, Home Harvest may revise the scope of work, adjust pricing, delay service, or decline to continue where necessary for safety, practicality, or business reasons.

No Guarantee of Garden Results

Home Harvest strives to provide quality service, thoughtful planning, and practical garden solutions. However, gardening and plant growth depend on many factors outside our control, including weather, climate, pests, wildlife, disease, soil conditions, drainage, shade, sunlight, watering practices, maintenance consistency, plant quality, seed quality, and other environmental variables.

For that reason, Home Harvest does not guarantee specific results, including plant survival, harvest quantity, crop quality, pest resistance, disease prevention, weed control, seasonal success, or long-term performance, unless expressly stated otherwise in writing. Any guidance, planting strategies, maintenance suggestions, or educational materials are provided in good faith but do not constitute a warranty of success.

Educational Content, Downloads, and Newsletter

Our website may provide blog content, planting guides, service information, newsletters, downloadable resources, and other educational or promotional materials. These materials are offered for general informational purposes only and are not a substitute for professional advice tailored to your individual property, growing conditions, or legal obligations.

Home Harvest does not warrant that educational materials or recommendations will be suitable for every customer, region, season, or property. Your use of such materials is at your own discretion and risk.

Without limiting the foregoing, Home Harvest’s total liability for any claim arising out of or relating to the website or services shall not exceed the amount actually paid by you to Home Harvest for the specific service giving rise to the claim, or one hundred Canadian dollars (CAD $100), whichever is greater, unless otherwise required by law.

Indemnity

You agree to indemnify, defend, and hold harmless Home Harvest and its owners, employees, contractors, affiliates, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms, your misuse of the website, your violation of applicable law, or your infringement of the rights of any third party.

Force Majeure

Home Harvest shall not be liable for any delay, interruption, or failure in performance resulting from causes beyond our reasonable control, including but not limited to severe weather, storms, floods, fire, natural disasters, labour shortages, supply chain disruption, transportation delays, illness, internet or hosting failures, government action, or other unforeseen events.

Any dispute arising out of or relating to these Terms, the website, or the services shall be subject to the exclusive jurisdiction of the courts of Ontario, unless otherwise required by applicable law.
